Print Permission and Stock Rules

I am beginning to feel like a broken record....what part of "PRINT PERMISSION ON A PICTURE BY PICTURE BASIS" and what constitutes a "Manipulated Image" that people do not understand. I have spelled it out very easily, given examples and thoroughly gone over this numerous times. But people just do not seem to get it.. They either do not READ THE JOURNAL RULES or just do not give a damn..
Every stock art of mine states to read the rules. I don't want to be a bitch about this, but apparently it goes in one ear and out the other. NO PRINTS WITHOUT PRIOR PERMISSION for DeviantArt. NO PRINTS PERMISSION for outside prints either. This especially applies to Redbubble... Now if your artwork uses only a small portion of my stock or is so well manipulated that my stock is not the center of attention then chances are i will allow prints on dA,, and quite possibly outside. But if you can not take the time to actually READ MY RULES first and ask permission first BEFORE POSTING IT AS A PRINT then I am not going to give permission. Plain and simple give me the courtesy of reading my rules and I will be more amenable to allowing prints. Am I tired of looking like a bad guy and being called names because I call someone to task over prints.
I am not the bad guy. I work my ass off making stock for you guys. I will not be made to feel bad because you can't be bothered to read the rules.




HOW TO DEACTIVATE A PRINT

OK, so you activated a print and now you want to turn it off but can't figure out how and finding the FAQs for it is nearly impossible... lol.. well here is the current way (apparently they changed it recently):
At the top of your screen where you see :
SHOP devWEAR Critiques etc etc you will also see "MORE" .. click on more, go to SUBMIT AND ORGANIZE and click on it. Then click on MANAGE PRINTS ... that will bring up a list called "Your Prints Store", click on YOUR PRODUCTS that will bring up a screen with all of your artwork that is Active Prints...
Select the one you want to deactivate by clicking next to the name of the artwork, then at the very bottom of the page click DEACTIVATE SELECTED PRINTS and that should turn it off.




PRINT PERMISSION ON A PICTURE BY PICTURE BASIS
While I have been having problems with people not understanding the rules, instead of saying NO totally to printing, as it is not fair to those who do follow the rules, I am going to institute a picture by picture permission policy. In other words, BEFORE you can offer it up as a Print I want to see it first. Once I approve of it, then you can offer it up as a Print.
And if you are an artist who has used my stock before and made lots of prints and have followed the rules, let me know and I will look at what you have made and I might give you Blanket Permission for prints, so you don't need to ask every time.

Since quite a few people can't seem to get it through their heads what constitutes manipulation of an image for print purposes...i.e. If you want to make prints you must thoroughly manipulate it by mixing it will other stock or your own imagery, so that MY STOCK does not constitute the majority of the picture..You can't just add a circle or a unicorn and expect to make prints from it..
Examples of what I consider acceptable for Print Permission:

as you can see my stock is NOT the focus of the picture, but aids in creating the overall image.

Examples of UNACCEPTABLE for Print Permission: ( these artists did NOT ask to make prints,they followed the rules. I show them as examples only of what is not printable)




NO OFFSITE USE OF MY NEBULA WITHOUT PRIOR PERMISSION
3) My nebulae are now off limits for putting on other websites unless you ask first and I approve it.. dA use ONLY> Do not upload it to another site and THEN tell me about it.
You may still use my fantasy scenes if you manipulated them off of dA for Ponybox and other horse sims without asking first.
Any other use of my stock you MUST ASK FIRST before posting outside of dA.

4) You must note me and send me a link to the manipulated images you make.

I still want to provide stock for you to use here on dA, but because of the number of ungrateful people who think that all of my hard work means nothing, and that they should be able to do what they want when they want with my stock, and in many cases not even FAVE it, I tell you,you have ruined it for everyone else. I will also no longer be posting extremely large sizes of my artwork. It will be no larger than 1600x1200.
I am sorry to have to do this, but I am tired of the whining and complaining.

Any one complaining and whining about my rules, or who fail to follow the rules will be BANNED from both of my accounts.


5)You may use my stock in any manipulation. You do NOT need to ask me first. If it is in the STOCK CATEGORY then it is STOCK and may be used by you.....................With only a few exceptions:

MANIPULATE THE DAMN THING... don't just add a small pic or some little stock from someone else and expect it to be called a manipulation!!! Especially with my nebula. Adding a small pic and uploading it as a manipulation is not only not ART but it is a gross misinterpretation of what a manipulation constitutes. Manipulating a stock means adding a lot of other things to it, so that it complements the manipulation. Stock should be used as a medium to achieve your vision, and not be the total piece itself. It makes others think you have created the whole thing,and I work too hard on my pieces for someone to come and act like they created the whole image. Most people do not look at the credits, they look at the entire picture and figure you made it. So be true to yourself as an artist and respect the work stock people put into their art.

NO PORN, sexploitation, or pics depicting cruel and otherwise socially, morally reprehensible acts. You must FAVE the Stock if you download it! Especially since I will be Faving your manipulation in return.

You MUST CREDIT ME! A link to my stock account is all I ask along with Moonchilde-Stock. This should appear in your artist's comments box.

Make sure that you know which of my stock are RESTRICTED and UNRESTRICTED... as most of my rules ONLY apply to Restricted Stock.


COMMERCIAL USE
6)COMMERCIAL USE: You MUST NOTE ME and tell me what project you plan to use it in FIRST. In some cases I might charge for usage, and in others it may be free depending on the stock and the project it is used for.......

Restricted and Unrestricted Stock Use:

I have now organized my Stock into separate folders pertaining to the types of stock,i.e. Nebulae and Scifi, Fractals, etc. This stock is Restricted to the uses stated in my Journal ONLY. I have also added a new category called Unrestricted Stock which contains a little bit of everything and can be used personally and commercially as per the Unrestricted policy located on dA.
What is Unrestricted Stock:
Unrestricted stock can be used for both personal and commercial projects, but it cannot be redistributed as stock. You are not required to obtain permission prior to using the stock off site or in DA prints. The only requirements are that the stock provider be notified and credited.

7.Copyright rules are below. (This applies to any and all stock I have, restricted and unrestricted)


If English is not your language and you have difficulty understanding these rules, please note me with your question and I will try to explain it in a simpler way. I do know Spanish, so I can at least explain it to you in your language.( Hablo español, así que puedo explicarles en ese idioma si se necesita)

GIVE CREDIT!!!!!!!

Please remember to give CREDIT to the Stock artists. I
have noticed several people uploading pictures using stock,
mine included, and have not given credit. It is only right
to acknowledge your sources and most of us require it in
order to use our stock.
Also NOTE me when you use it with a LINK to the
artwork you have submitted. I do not have time to go
through your gallery looking for the picture. I will always
FAVE any artwork that uses my Stock, but I need a link
to it in order to do that.


COPYRIGHT VIOLATIONS!!!!!!!

Please do not VIOLATE COPYRIGHTS!!!! If you use my
stock and then put images you got off of the internet
that are not yours, not only will I not fave it, but I will
report the violation. Let me explain:
A company owns the
copyright to any and all logos, photos, characters etc
that are associated with its product. So unless you get
permission directly from that company to use their
copyrighted images, logos etc then you can not use
them and are in violation of copyright laws. Same
applies to any images of them that you find on the
internet, just because someone posted them does not
make it legal to use them. Same with screen captures
from TV. Even if you give the company credit, it is not
alright, because they have not given you permission to
use them.
It would be like you creating a fantastic piece of artwork
or a character from scratch, totally awesome... and then
people start using it to make their own things without
ever asking you..or saying that it should be OK since
they gave you credit, or that they saw another site
using it, so why can't they... Too many times people
assume that if they give credit to the company that that
is OK and covering the bases. but it is not....It is still a Copyright violation!
I hope this explains it a little better...
and why I will REPORT you and not Fave your work.

Who says that deviants get no breaks. I can finally speak of my break now. Geoff Mandel has created a wonderful 2 sided Map of the Verse of Serenity/Firefly, licensed merchandise. It is exquisite in it's details and is a big hit this weekend at the Serenity Con in Burbank, Ca. So why am I jazzed about it, (besides being an avid Serenity/Firefly fan)?? Three of my nebulae grace the front of this artwork, forming the background. It was a fantastic honor to be asked to provide the backdrop artwork. And now that it is available for sale I am going to promote it on both of my accounts.

AMENDED STOCK RULES!
Apparently sometime recently, stock rules changed where you can no longer use another stock along with your own to create new stock. In the past this was allowed if you got permission from the other stocker, or if the gallery manager said it was OK,, I have recently had some of my stock removed as Art Theft because of this..so i will deleting any and all stock of mine that contains other peoples stock even if they gave me permission,, And I also rescind any permission I have given for others to do the same.
